“An investment” can mean different legal arrangements: buying property directly, acquiring shares in a company, financing a project or investing in a regulated security. Before assessing returns, identify the true nature of the transaction.

01

Define what you are acquiring

Ask the proposal to state precisely whether it offers a real estate right, shares, a contractual interest, debt or another instrument. If the transaction is a public offering or involves securities-market intermediation, check the applicable authorizations and registrations with the Superintendencia del Mercado de Valores. Law No. 249-17 seeks an orderly, transparent market and investor protection.

02

Verify the counterparty and their authority

Recognizing a brand or speaking with a representative is not enough. Verify the entity’s legal identity, current status, signatory’s authority, legitimate relationship to the asset and, where applicable, the owner’s authorization. No payment should precede this verification.

03

Confirm the property’s legal status

For a real estate transaction, compare the title certificate with an up-to-date legal-status certification. This official document confirms the property’s registration status and shows current entries in its supplementary register, including rights, charges or encumbrances recorded at issuance.

04

Review feasibility, permits and project conditions

A valid title alone does not prove that every proposed development is feasible. Depending on project type and location, review surveys, access, permitted use, environmental status, municipal approvals, available infrastructure and any special regime. Conceptual images never replace this evidence.

05

Put promises into written terms

Price, subject matter, schedule, conditions precedent, use of funds, consequences of breach and refund mechanisms must be documented before transferring money. Use identified accounts, retain receipts and seek independent legal, technical, tax and financial review.

A sound opportunity withstands questions, documentation and verification time. Unjustified urgency, guaranteed returns and reluctance to identify responsible parties are reasons to stop.
